apprehended, and to be sent to Macao, three Portuguese Subjects who had been accused of Robbery, and had taken refuge at Hong Kong.
On the receipt of this letter, Sir John Davis wrote on the back of the Portuguese Governor's letter, "Let the Acting Chief Magistrate deliver the three Persons, herein named, to the Warrant of the Governor of Macao". Mr. Hillier, in obedience to this Mandate from his Official Superior, apprehended two of the persons named in the letter, and they were sent over to Macao by Sir John Davis's Orders.
Subsequently, these two persons, namely, Franciscus de Azeis e Fernandes and Cypriano Antonio Pacheco, entered an action in the Supreme Court of this Colony against Mr. Hillier for false imprisonment, and laid their damages at 25,000 Dollars. The case was tried on the 4th May last, and the Plaintiffs were nonsuited; but as the parties in the colony when the trial took place were not likely to return, the Defendant Mr. Hillier, although successful, has no one to look to for the costs that he necessarily incurred in defending this action.
These costs amount to Two Hundred and ninety-six Dollars and forty cents, and Mr. Hillier has been compelled to make them good to his attorney.
On this question being first brought to my notice, I inquired of Mr. Hillier how it happened that his attorney had not moved the Court to order the Plaintiffs in the Action to find security for the costs (should they lose the Suit) they not being resident inhabitants of this colony, and having no property therein.
